  3. We can't know that, or state it with certainty. We weren't in the courtroom; we didn't hear the evidence. I was not referring to the particulars of this decision. I believe the entire system, wherein we all agreed that family court judges can pretty much do whatever they want, is capricious. I tend to think this particular decision is an outgrowth of that capriciousness but you are right, without being in the courtroom there is no way to state that with certainty.   4. I agree with you that I don't necessarily think this is the way it "should" work. I agree that parents, even divorced parents and maybe especially divorced parents, should be the ones who decide how to spend time with their children. In effect what this judges decision does is allow one parent to control how the other parent spends time with his children. This is just awful and sets up awful post-divorce dynamics that are not beneficial to the children. The judge does not need any specific statuatory authority to prevent somebody from skydiving during visitation. He just does it because he wants to. Doesn't really need any reason at all. It is capriciousness at its worst. "What if there were no hypothetical questions?"
  5. While I wish that was so I am willing to bet that it is not. Family court judges have extraordinary discretionary powers and it is extremely difficult to have one overruled. "What if there were no hypothetical questions?"

  9. I'm still in favor of it. I am not saying that the results are pretty. However I have yet to see an election that was. I don't think an ugly election process is a good reason to deny free speech anyway. At least everybody knows where Newt got his money from and can make an informed decision based on that. The large corporations pretty much got around any limitations on donations that were imposed anyway. "What if there were no hypothetical questions?"
  10. I'm just starting that process myself ... I so DO NOT look forward to the certain impending frustration . O Hit snag #1 today - because of tighter lending requirements, I cannot get a conventional loan without having a paystub from the job I am going to be starting - in March. We're trying to close by middle of Feb. Annoying. Yeah, that is an underwriting requirement. The most frustrating part of going through this is that they will change what they require. One house I bought, the bank had everything requested many weeks before closing. Called them every 2 days (directly to underwriting) and asked if that was everything. Each time they confirmed they had everything they needed and everything was on track for closing. Day before closing the underwriters came up w/ a list of additional documents they needed and said they couldn't approve it without them. Special circle of hell, I tell you...   16. Just to reply to the original post, if I was in charge of an event like this I would deposit the checks and then issue refunds if the participants wanted them. I would not tear up or send back checks. That does not create as good of a paper record. Deposits and refunds are very, very clear entries in the ledger.   18. I am intrigued by this idea. I have been quite explicit in my discussions with my family members that I am a big boy and understand the risks of skydiving and would not want anybody sued if I died. I have had that converstaion more than once with my family members. I also sign the waiver (of course). I would like to think that is sufficient, as my family members are generally not the type who would sue anybody and they have participated in "waivered" activities themselves but grief is a powerful thing. I have not thought about videotaping a statement. I would be interested to hear more feedback from others on this. Does it offer more protection for the sport I love and the people involved in it who are my friends? "What if there were no hypothetical questions?"

  21. The 'roid rage' cop was busted from video evidence...which shows that it doesn't always work 'for them and not for us' as you claimed. Right. let's pretend that this case was in Washington. There is also another defendent, arrested by the same police officer for a similar offense. He states he fully informed the officer he was carrying, complied with all applicaable laws etc. but the officer went apeshit and arrested him and charged him with assault and brandishing. That's his defense. As part of his defense, he wants access to other complaints or similar cases against the officer including the dash-cam footage. This case the county is saying the defendant can't access dash-cam footage from any other similar case because that would violate the officer's privacy rights. No more screw-ups, or at least not that one again. You have a seemingly encyclopedic knowledge of materials and list of suppliers. Finding a supplier or material question that you don't know the answer to, well....not a common occurence. I did find by some googling that a Ukainian company called Sky Country made a parachute called exSCalibur from the LCN 0286. So that is one more datapoint along w/ the previous post referenced.   24. The AAD fired. The reserve came out. It's lines entangled with the jumper. Any talk about the AAD being faulty appears to be wrong, at least according to the incident thread. Be interesting to know what exactly the lawyer is alleging is "gross negligence." That's a pretty high standard. Perhaps it is in his pleadings. From what is reported in the incident thread this does indeed appear to be nothing but a nuisance lawsuit. "What if there were no hypothetical questions?"
