No different than LA breaking its contracts with Arizona based companies/services in its boycott. That's a fair point. My only response is pure speculation. The article quoted in the original post refers to "future" contracts. LA could simply not renew present contracts that may have an expiration date. This would not be breach. But if the AZ power compnies breach their contract(s) to supply power to Cal. cities this summer, they will likely get the crap kicked out of them in the lawsuits that are sure to follow. But you are right -- if LA breaches present, binding contracts it has with AZ cities, it will get sued as well and probably lose. Any other lawyers who know more about this than I do, your input would be helpful. You're probably correct. However, with power generation being what it is, I think that there are several clauses that relate to "shock" factors to initiate renegotiation. Here's the letter from Commissioner Pierce... This is a funny post, especially in the context of someone who is a Commissioned Officer in the Army...and therefore expected to bring forth a set doctrine, which, among other things, mandates behavior, actions, and even thought to a degree. The video on page 2 pretty much removes any "confusion" that the article is trying to apologize for. What pisses me off most about this is that Blumenthal is a Marine (reservist or not) and is a very talented lawyer. There was no need for this to come under scrutiny...if only he had chosen his words more carefully. I don't fault those that served, in whatever capacity as long as they did so honorably. I have no reason to doubt that Blumenthal did not fulfill his commitment honorably. His statements (and I've heard them first-hand) about serving in Vietnam (I had no reason to doubt him at the time) expose an element of his character...now everything is up for question... It's just their way of saying they don't feel they can afford you, or, they think you won't have any longevity once the economy turns around. Push back and probe their discomfort.
