  1. Ok...I searched the internet as best as I could and could find no answer to my question. That's why I came here. I've gotten some pretty good answers here in the past so although I don't totally rely on this site for information, it's still a good place as there are some lawyers here that can answer the things that pop into my head. Now.....my reasoning... I sat on a jury this past week and it's been burning my heart out. I saw a video of an 8 year old's footprints in his grandmother's blood where he had to walk into her blood and saw the blood trail across her body where he had to climb over her dead body in order to get out of the room, all the while with a .380 against his head and the threat of "you'll be next" ringing in his ears. He was then kidnapped, along with a 4 month old infant, and put out of the car in the cold morning air with nothing but his pj's on and the infant was wearing just a diaper. The 22 year old woman was taken to the woods, raped, sodomized and threatened with death for over 4 hours. These images seem to be burned into my head and I can't get them out. The bullet that hit the grandmother was dead between the eyes and they showed the body on the video to us. I voted for death but here in Alabama 10 out of 12 jurors have to recommend death as opposed to 7 out of 12 recommending life without possibility of parole. If the defendant gets an appeal, wins and gets the sentence dropped to life with parole, I can't imagine justice being done for the two children or for the grandmother. It was pretty horrible to sit through and I can't begin to imagine the horror of the 8 year old boy, nor how it will affect the rest of his life. I'm not sure how this will play out in the end. I just know that I gave my best judgement in this case but it bothers me that he may have a chance to live outside a cage at some point in this life.   2. Thank you, Jorge but this concerns a 34 year old man that shot and killed a 53 year old grandmother in front of her 22 year old daughter and 8 year old grandson back in October of 2004. He was found guilty of capitol murder on Thursday and on Friday was sentenced to life without possibility of parole. An aggravated circumstance is - he was charged in 1993 with attempted murder but plea bargained down to assault 1. My question is - can he get an appeal and have the sentence dropped to life with possibility of parole, giving him the opportunity to be released during his lifetime?   3. Alabama... Is there such a thing? Or is there an appeal process that can overturn a conviction of Capitol Murder while committing a kidnapping/burglary? I ask this in all sincerity. I know the law is different in individual states and this takes place in Alabama. I'll go into specifics as soon as I can get a real/true answer for this question. I've got an Ovation Custom Legend that is brand new - only played a couple of times - and then sat in a corner in the case for over four years, waiting for someone to come along really wanting to learn.   12. Yeah, Dave. It's a special edition and the 460th of 1000. At least the plaque on the dash says so. It lists for $62,000 but I got it for a lot less.   14. I've owned a Garmin 2620 for about 5 years and love it. I update it about every two years and wouldn't have any other brand. I recently bought a 2009 Dodge SRT8 Super Bee with a built in NES system and it just doesn't compare with the Garmin. I guess I'll get over it all eventually but it just irks me that the bastard did it while I was in the hospital. The insurance paid off and I'm in the process of rebuying tools and the rest of the stuff lost. Thanks for the bit about getting out of the hospital. Man, that place is like a prison. I had so many tubes and stuff stuck in me that I couldn't even roll over on my side. Had to stay flat on my back the whole time but the Morphine and the Diladid helped a bit, lol.   17. A neighbor saw one of the three bastards walking past my house three times and then head down the driveway. My neighbor lost track of the jerk when as he topped the small hill but went down to a friend's house, got back up and came back, only to find the sneaky bastard gone. They called the sheriff but couldn't find anyone. Two days later the guy came back at night and wiped me out. My neighbors didn't want to tell me while I was in the hospital so they waited till I got home, met me in the driveway, told me about it and that's how I found out. I'm having to remind myself that it's only material possessions and that the insurance people were good enough to already pay me in full for the loss of them. You are dead on right about the peace of mind. I've worked pretty hard to turn this place from a house into a "home" and it gets discouraging to think that nothing is safe anymore. I've been on this earth long enough to "know" that time heals the mind so I just have to keep reminding myself of that each time a car drives by and I reach for a weapon. I'm also greatful that I wasn't here when it happened cause someone could have been hurt or worse and the last thing I want is to have that on my conscience. Again, thanks for the kind words.   19. Thanks, April. The little bout I had a couple of years ago with cancer came back and that's what happened to put me in this shape. I'll get over it again, tho.   20. Yep, you are right. It's only material stuff and luckily I have full replacement insurance so I didn't lose any real money.   21. I'd seriously like to do more than bitch slap the bastard but I guess I won't get the chance if hegets caught first. Reinforcements? The only friends I have here are about my age and don't think "retaliation". The only skydivers close to my location are Billy Vance and Auburnguy and I don't know either one of them so reinforcements are out of the equation. All of my friends live in Hotlanta and that's too far to drive just to babysit with me, lol. Oh well...nice suggestions, tho.   22. Well, dudes and dudettes, For the third time in as many months I've been stuck in the hospital with serious injury/surgery. Only this time, as I lay in I.C.U. with tubes sticking out of me everywhere, and being pumped full of Diladad and Morphine, my home was burglarized. They hit me for over $4000.00 worth of stuff, including power tools that I had been using to cut and place a hardwood floor with and a handgun (H&K .40 usp S&W). I spent a lot of time making this place a home, not just a house, and I'm mad as all hell. My insurance paid off today and I immediately ordered a Baby Desert Eagle to protect myself with cause I still have over 60 staples in my abdomen and have no way of protecting myself in case they come back. I also renewed my CCW permit. I'm also 61 years old and not in good shape anymore. I dropped from 195 lbs to less than 150 lbs in the hospital this time so I'm still weak as a kitten.
