Texas allows concealed carry while drinking in a restaurant because, unlike bars, restaurants do not provide an atmosphere that promotes drunkenness. I suppose the law could be changed to allow carrying in bars but disallow carrying by anyone who's had a drink, but I prefer it the way it stands. There has been so little misuse of concealed handguns in Texas because CHL holders use their heads, something that is often hard to do when you've been drinking.

All I'm seeing in that paragraoph is "Let's disarm them, it's for their own good, and we know better."

ps - some states disallow carrying in any establishment that serves alcohol based on logic like yours. Others don't allow it at all, based on logic like yours.

You better believe it. I saw an example of that last weekend in Wal-Mart.

Old guy could barely walk, looked like he was older than dirt. Walked with a cane and had glasses so thick they were probably bullet proof. Had a .357 on his belt that keep dragging his pants down on one side and on the other he had a short shot belt with six rounds (he had on boxers by the way and I'm guessing it would take him 5+ minutes to reload based on how badly his hands were shaking). We were waiting in line at the Deli counter and he barged his way up to the front and demanded to be served first - a first rate asshole.

But I found myself thinking, if someone who couldn't get a gun wanted one, here was one for the taking. If deadly force were required, I seriously doubt this chap would have had the ability to put rounds in center mass, much less someone's skull. Probably would have killed a bystander in all likelihood.

I'm a libertarian at heart and vote so, but sometimes I see shit that just ain't right.

Ahhhhh, maybe. My mistake. Interesting state, Arizona. About 20 years ago, they had a law for a short time that when you got pulled over for drunk driving and blew over the legal limit on the breathalyzer, you went STRAIGHT TO JAIL FOR 90 DAYS; didn't matter who you were. Something to do with consent to the mandatory "waiting period" as part of getting your license. Happened to a close friend of mine; I had to pick his car up from impound. HARSH.

Why wouldn't they allow it in such places?

The theory behind those kind of common exclusion zones is that in those places emotions can run high and some people sometimes act irrationally.

I've certainly seen sports fans get mad enough at a game that I wouldn't want them to have a gun. But generally, people like that who can't control themselves, have already run up some kind of criminal record shortly after reaching adulthood, and wouldn't qualify for a concealed carry license anyway.

Who are the "us" and "we" you refer to? Is it "we the people?" Do you disagree that "we the people" should occasionally make laws to protect our common interest? I'm not suggesting doing anything for anybody's "own good," I'm suggesting protecting myself and protecting the gun rights I've fought for by not allowing assholes to carry their firearms into a bar and have a few too many. The big argument against concealed handgun laws was that it would turn America back into the wild west. That scenario was avoided by screening applicants and, in most states, eliminating the deadly guns/alcohol mix that was the catalyst for so many old west gunfights. Concealed carry works because of common sense--You don't threaten someone if they may be armed. As most skydivers can attest, common sense goes out the window, with enough liquor. Maybe everything would work out okay if every state started allowing concealed carry in bars--I don't really know. I can only explain my own personal philosophy on the subject. But don't use that broad, ultra-right wing, closed minded paint brush of yours to paint me as some sort of socialist just because I think there might need to be a few minor limitations on what American citizens can do with their firearms.

Does anybody believe that bar patrons who have license to carry concealed firearms strip themselves of them whenever they go into bars currently? All the law will be doing is legalizing what is probably done all the time now without incident.

I find it odd that you say, "Talk about the Wild Wild West." Concealed carry was predicted by anti-gun fearmongers to result in "blood running in the streets" and that hasn't come anywhere near close to materializing, much as the anti-gunners were wishing it would so they could push their gun-ban agenda.

You're comparing apples to oranges. Nobody says you can't drink at a bar before driving home. The laws do say, however, that you can't drive home with an open container of alcohol in the car. Carrying in a bar is akin to having an open container of alcohol in your car. You can hang out at a bar and even drink, then drive home; you just can't have an open container of alcohol while driving home. Likewise, you can hang out in a bar and even drink, then carry on the street; you simply can't carry while in the bar. Both laws are built around the same principal of preventing people from "loosing control" while in a position to do serious harm.

And what kind of sense does that make? I can do 3 shots of tequila, get in my car and drive and not be over the limit because of my weight and the rate I metabolize alcohol. However, I can't have a coors lite in a rush hour traffic jam.

Yep, I volunteered at the police dept. to train new recruits on recognizing alcohol impairment. They picked me up at home, took me and a dozen other guys to the station. Gave us free booze while we played video games, and every half hour gave us a field sobriety test. Then they drove me home.
