It doesn't pay to be nice

I'm convinced it doesn't pay to be nice. Maybe its naiveté, but I honestly expected that being nice would make things easier for me, rather than harder.

Last Thursday I'm rear-ended, and due to the lack of damage to my car, and the fact that I know this woman, didn't call the police or file a police report. The lady offered to pay for it out of pocket if I brought her the estimate. So Friday I bring the car to a service station and get an estimate. A bit more than $400 total for repairs. She balks at the price and decides that she wants it to go through her insurance instead. Fine... Now its Friday and the Insurance adjuster has yet to see my car, and I will be going the weekend without my car. I call her insurance agency to find out about getting a rental, and am told (very rudely mind you) that she doesn't have the authority to give me a rental and doesn't have much sympathy for me. I felt like reaching through the phone and choking her! "Its your insuranee that hit me bitch!" grrr...

So now I'm without a car until at least Tuesday. If I had filed a police report my own insurance could get me a rental, but alas I was too 'nice'.

So, a word of warning - don't be nice.

That sucks :(

I would try to talk to a supervisor at her insurance company. They have to get you a rental car or pay you for one.

Would the lady who hit you be cool enough to get you a rental?

it could have been worse... at least it wasn't a hit and run..:)I know it sucks though. I just went through the same thing with an insurance company. Some guy hit my car while it was parked. It took the insurance company like three weeks to get me the money.

1. Call them again and talk to a manager (try not to shout or discuss their parentage)

2. You can rent a car yourself and claim back the money from them. Downside is it means money out of your poket now and there is the risk they may not want to pay up.

3. You are going to have a loss of use claim. (UK this is £5-£10 / day) This means you will get a sum of money off her insurance co to compensate you for the hassle of being without a car.

I think I'm more upset at the principle of it. If I really wanted a rental I'd get it myself - but I don't want to spend the money and its not like I don't have any transportation - my husband has his car...

its just annoying. I'm most upset at how rude the insurance lady was. Why should I be the one inconvenienced? Its her policy holder that hit me!

ugh! I learned my lesson - won't be nice again!

with hair that color I'd expect that you'd be a little chilli pepper in certain regards;)

Bummer:( Never mix business with pleasure. Just a couple days ago I was in a similar situation, however didn't know the guy. I am in a rental car since the hail damage on my car is getting fixed. There didn't appear to be any damage but I wasn't about to take any chances. I called the police to come out so a report could be made. Maybe if you call her insurance again, they might have a certain rental car place they use where they can automatically be billed......just a thought! Best of Luck! It doesn't pay when it involves cash. People do studid stuff when money is involved. More money, more stupid. Usually, I take the time to get everything in writing.

Buy a house, or get divorced, and you'll understand. The paperwork spells out everything because people have different ideas about what is "fair".

My definition of "fair" - a place you take pigs in the summer.

Keep being nice. Nice people get surrounded by good and bad people. They just have to figure out who is column A, who is column B.

People who are not nice, lose the good people and eventually are surrounded by only people like them. That sucks as a way to live life.

I once had a friend that dyed there hair black, then it grew out, and they dyed it orange, (with the black tips mind you. And then after that started growing out, the blond roots were showing.

Lol, they looked like one of those candy corns that are passed out on holoween.

Have you let your insurance company know about this? You should, as they can help you out, too. They will likely be able to recover anything they put out from the other lady's insurance. But, get an agreement that it will not be counted against you (in writing)

But, don't be so sure about receiving a rental car. Not all insurance contracts include it.

Unforutnatley I did call my insurance co. to get the bad news. Becuase the total damage is less than $500 (therefore under my deductible), there isn't much they can help with...

Just have to wait to hear from the adjuster, which, if everything goes as planned, will happen today.

Thanks for everyone advice, there's not time limit on filing a police report in Providence, and will be doing that this evening.

Everyone always reminds me that nice guys finish last. Truth is, nice people do tend to get stepped on. Still, that doesn't mean that you should stop being nice. I tried being not so nice once and found that I couldn't pull it off. It's just not me. I get the idea that you're going to be true to yourself no matter what anyway.

Now.. I have found that it's possible to be nice without leaving yourself too vunerable. Filing a police report for a car accident is pretty much standard procedure. It's good that you're still able to get it all taken care of. I look at it this way.. if someone hit's me, by law that's a moving violation and they should be held responsible for thier actions. So... by filing the report you ARE bing nice because you are helping that person be responsible and own up to wht they have done. See :)

Follow Up:

Got a rental.
Called insurance co. directly instead of dealing with lame agency.
Insurance co. moves at lightning speed.
Sends estimator.
Sends me check for $1500
Pay for rental in full.
Repairs to exhaust will cost $400
Remainder is for a new bumper which I won't be doing.
$1000 to pay off credit card so I can start AFF without any $$ worries.

Life is good again!
