IMGR2 0 #1 March 29, 2004 There are others here that have much more of the story but it looks like I have to start it. This is sad and funny at the same time. Sunset load in San Marcos there was a jumper who had a cutaway and a couple of guys followed it down on to Farmer McNasty's property. This is were my part of the story gets vague but one of the local packers got run down by McNasty in his pickup truck. Broken wrist and a ride to the hospital in an ambulance. I guess you should mention however that Farmer McNasty was told by one of the jumpers who landed there what had happened & why they were there, then Framer McNasty proceeded to run our packer down.....I think that's called attempted murder. bluskidave 0 #6 March 29, 2004 I guess the earth is not a drop zone.I've landed off a couple of times on farmer Mcnasty's land and I must have been lucky that he didn't try to shoot me.I took all my gear home figuring that if he is crazy enough to try and run someone over and actually succeed there is no telling what he might do next.Bad part is Chad's income will be hurt since he is one of our packers.Maybe we will refer to Chad as farmer Chad in the near future. He has been known to try to rip gear off students, confronted with a large knife, he has said that he has a large collection of gear stored in his shed...He also makes sure he parks his irrigation system AS CLOSE to the landing area and in the worst spot possible as he can<--- See look, pink dolphins DO exist! If the canopy lands in his land and he does in fact do this, is there any legal action that can be taken to repay for damages and such?? Once, someone landed out, injuring their leg and thusly could not walk out. Well, off goes the manifest in the golf cart. McNasty got in the way and wouldn't let her in to help with the injured party. He then had to nerve to threaten with action when she pushed him aside to get to the downed jumper. Some people! It's got to be very clear to you that you are not allowed on the land, otherwise it's not trespassing and all they can do is tell you to get off. Does anyone know about this???? It depends on the jurisdiction. Technically, it is a trespass. However, under certain circumstances, your liability is limited to actual damages. One way or another, it IS a trespass. And from what I hear, deadly force is authorized in some circumstances with regard to property in Texas. In tort, the skydiver landing off would usually be liable for any damages suffered by the landowner, including nominal damages for simply being there. But then, I don't knwo about different states. I told Chad's story to a workmate who said she has a cousin who sued a balloonist that crash-landed on his sod farm. I can see a valid case here, you caused damage to his livelyhood if you damage the sod (and it's very sensitive)... But I don't think the use of deadly force would have been even remotely justified. The balloonist had to pay reperations but nothing beyond that as it was clear that he had to come down and he had to come down there. I suspect the same for a reserve ride or even just a bad spot.
