  6. [I've done four tandem and am now on to learning freefal and all the maneures with my own cute on my back. ] 4 tandems - all I can say is arch, relax (SMILE) and LEGS OUT.   8. Yes. I believe this discussion was brought up at the USPA board meeting and with as many dzo's that are on the board it was thrown out. One of my suggestions was to be a GM DZ they must have a satisfactory rating with the better business bureau. One director told me that wasn't feasible, yet I managed to look up pretty much every dz listed in less than 1 hour. I did find 2 dz's with unsatisfactory ratings. One of them had several complaints against them and they are still a Group Member DZ. Be kinder than necessary because everyone you meet is fighting some kind of battle.
  9. __________________________________________________ What I find laughable (or scary, depending on my attitude at the moment) about this whole thread is that no one seems to mind signing a waiver (or, in the case of the person who started the thread, requiring customers and students to sign waivers) that effectively means you or your heirs can't sue the dz if the dz's airplane crashes (i.e. covering the dzo's ass). It's okay for the dz to cover their ass, but apparently it's not okay for an equipment manufacturer to do the same thing... __________________________________________________ I don't have a problem signing a waiver - just this one BECAUSE the way it is written. If you read RWS each paragraph contradicts the next. Paragraph 3 states NO WARRANTY EXPRESSED OR IMPLIED but Paragraph 4 addressed the WARRANTIES listed in #3 but there are no warranties. Why do they have that in there? Every time I read it, and I have been over it at least 10 times, trying to understand it, it gets more and more fishy. The manufacturers are covered in the waiver that we sign at the dz. After talking to several other Vector Tandem Rig owners, they new nothing of this agreement. This agreement also states that if I sell the rig, I HAVE TO get the new buyer to sign the agreement before I deliver the rig, if not RWS could sue me because I signed and agreement saying I would. If they want to control who, how, why, where, and when these rigs are used, why bother selling them and just lease them. I am probably a little head strong on this but I won't be blackmailed or bullied into signing something to get a piece of equipment for the tandem masters and the passengers safety. Yeah, so someone I'm sure will say that I am willing to compromise the safety of the TM and passenger by not signing it to get it. That is not the case, it just won't be used. I would rather have nothing in writting signed then something signed putting ALL liability on me. SELLER MAKES NO WARRANTY EXPRESS OR IMPLIED. - but it has been stated earlier in this tread that its implied they will make it all better but RWS won't put that in writing. What if Bill Booth sells RWS and the new people are a bunch of a-holes.   14. thank you all for your replies. I'm going to think about this for a while. Probably will just sell the rig. I'm not asking RWS to take all liability. I don't have a problem with most of the waiver. There are just certain parts of the waiver that I am very uncomfortable with (DEFECT IN WORKMANSHIP OR MANUFACTURING).   15. I'm not a pilot and will but isn't plane maintenance covered by the FAA and not the airplane manufacturers. I don't quite get the separation and student training remark.   16. that's kinda of my point. PD, Precision, Sunpath, etc. do not make you sign an agreement stating that if they make a defective product - its now your problem. Its because I feel like RWS is holding me "hostage" on this. I'm probably freaking out about this too much, but the way this agreement is written does not make me feel good about their products. How would you feel if you buy a car 2 years ago and now you need a new part, but you can only get this part from the manufacturer and in order to get it, you have to sign an agreement similar to this stating they are not responsible for selling you defective equipment. It makes you question the quality of the product if they need such an agreement. I am by no means implying (seems to be alot of that in this thread) that RWS makes defective equipment or would intentionally sell someone something that is defective, because I doubt they could do that and be in business for as long as they have been. This is the first time having to deal with them. One thing about their support - we ordered this drogue 4 weeks ago. It was not until be called them again to find out where it was did they mention this agreement HAD to be signed. I was never alerted to this agreement until yesterday.   17. If they put all these "implieds" in writing - i will sign it. They are trying to protect themselves and I am trying to protect myself. Mr. Booth (or anyone from RWS), if you are lurking - do you have suggestions, anything that would make me feel a little more warm and fuzzy about signing this?   20. yes, the waiver the student signs covers all manufactures, etc. As I read it, if they send me a drog that blows up on the first jump, its too bad, so sad, we don't stand behind our products. Had I known about this agreement, I would have done things differently, like getting a different manufactures rig.   21. How many of you Vector Rig owners have signed that user agreement? I am the owner of a Vector tandem rig. My husband is the tandem master that jumps the rig along with a few others that rent it from us. We ordered a new drog, (4 weeks ago) but RWS refuses to send it (just told us now) unless I (the owner) sign a user agreement. I read it, and until I have a few different attorneys look at this, I can't sign it. I won't take responsibility for something I can't control (i.e. manufacturing defects, poor workmanship, etc.) I understand the need for some of it, but I can't live with paragraph 3 and 4, releasing them from liability due to manufacturing defects, workmanship negligence on their part. I know we live in a country where suing is some peoples way of life, and companies need to protect themselves, but this is too much. Companies need to stand up for their products if they believe in them. It's time to put these lawyers to work on changing the laws on how, and why you can sue instead of making more paperwork.   22. My worst would have to be line burns across my face (cascade caught the corner of my mouth) I received in canopy collision. Had about 70 jumps at that time.
