  4. I don't think this is very legally cut and dried given the fact that taxpayer $$ infusion vice bankruptcy put AIG in its current state. IT SHOULD HAVE BEEN ALLOWED TO FAIL (I know who was president at the time and don't care). These bonuses are one more reason that beautifully illustrates that point. The bonuses in question were paid under contracts written in MARCH 2008 and were not performance based. The company is not bankrupt (it should be) with access to the requisite cash to execute the terms of its contract. Should companies owned by the State [barf; abhorrent concept] and all employees thereof be exempt from the ex post facto and contract interference protections afforded under the Constitution, Article I, Sections 9 and 10? I think that sets a dangerous precedent and a start down the slippery road to more State control ala the Soviets. Hmm...I can see why Democrats would like that. I do not. With regards to efficient breach, Robert Birmingham in "Breach of Contract, Damage Measures, and Economic Efficiency, 24 Rutgers L.Rev. 273, 284 (1970) (“Repudiation of obligations should be encouraged where the promisor is able to profit from his default after placing his promisee in as good a position as he would have occupied had performance been rendered”. I don't think that the case here, were these bonuses not paid as contracted. I don't like the damned bonuses. The company should be bankrupt.   11. There's not really much think to it - history tells us the answer is no. Though one might consider some of the work conditions akin to slavery that many immigrants were forced into upon and for quite some time after their arrival here. Indentured servitude was often little better than slavery in many regards.

  16. Oh dear God - St. Carl! That is so awesome. Aquinas and Augustine both said things with which I disagree - you've quoted a couple; there are more. Their logic on the death penalty is not among them. I've never heard Aquinas' logic on that subject rebutted by anyone. Nor Augustine's. I rather like City of God and its philosophy of Church, State, City of the World, and City of Heaven. Very interesting philosophical structure. With regards to the State and execution of citizens, I agree with him. Using Augustinian and Aquinan - or would that be Aquinic? - philosophy, it would seem to follow that in today's State, where one perceives the debt of the State to be a more malevolent threat to the general good than the continued life of the criminal in conjunction with the fact that it is less expensive to the State to keep said criminal alive, I think it within the confines of Augustine's philosophical beliefs/ structure to assume the death penalty in that case would be wrong. Aquinas' as well. Being as that mirrors my own current beliefs, perhaps one might call it the Anvil corollary to both Augustine and Aquinas?

  19. Not really. Latae sentientae has not been declared for support of the death penalty or participation in its execution - unlike abortion. The reason for this is that one may make a very cogent and Catholic argument in favor of the death penalty. I've no moral issue with the death penalty, rather I am against its use for fiscal reasons. We can't afford it. With regards to its morality, those in opposition rarely wish to discuss why they disagree with St. Augustine and St. Thomas Aquinas. Aquinas in particular and his objections and counters are quite well put. In fact, I can't recall anyone willing to discuss their opposition to the death penalty in context of their disagreement with either of those two doctors of the Church with regards to the death penalty - if they're of the opinion that it's morally unjustifiable, that is. They emulate democrats (except for Jeanne) talking about their support for racial discrimination - they run like cowards because they lack the courage to face facts.   24. I don't think a President is capable of managing the economy. Affect it, yes. Manage, no. Most Presidents don't really affect much until their budget is proposed and appropriations bills passed, but not this guy. He's already got legislation enacted. He's doing horribly. Spendulus and Porkulus - the stimulus [sic] bill and the $400 billion and some change pork bill - are both abominations. Horrid pieces of legislation. Made more horrid by coming in the wake of the TARP and the subsequent violation of the misappropriation act using the TARP to bail out GM/CHRYSLER that the preceding Congress with Bush administration concurrence/collusion thrust upon us. The economic headlines in the year following GWB's inauguration, even prior to his first appropriations bill being enacted, simply scourged the man over his handling of the economy. President Obama has enacted legislation - MAJOR legislation - affecting the economy and is still blaming GWB and his predecessors. With no push back from the Democratic Party's PR arm...er...the media. Compare and contrast that. LMFAO. He's doing horridly, to answer your query. But he's not managing the economy.
