In a rare instance, we agree. Bush set precedent (as is implicit in the role), Obama has run with it and set his own. It's already pretty damn scary. The really scary part is waiting to see what the next guy* does with that precedent when they get to play... :S

an interesting argument in favor of this is being made by those who supported the patriot act
They are saying that when put in place the left cried about the wireless wire taps so, all NSA activities were put under FISA. Now, since a judge gave them the warrent, this is all legal

Fair call. I was in this instance tying the warrantless wiretaps to the Patriot Act in turn to the NDAA and now the latest shit. But you're correct, overall it does boil down to what the last guy got away with setting the stage for what the next guy gets away with.

I don't understand all this talking about the Patriot Act. It is not mentioned in either of the articles. They are about departments of the US government including some that were around before the Patriot acting like general aviation pilots are an enemy and doing things the US constitution supposedly says they cannot do. This concerns me as a jumper, not whether Bush and the Republicns or Obama and the Democrats are the worse facists.

Which law has been broken?

As far as I can see all of the actions are within the scope of the law. The problem is that the law itself is bad, as SOME of us pointed out quite along time ago.
