Is It Kiddie Porn when the Kiddies are Taking Photos of Each Other?

Interesting case. Personally I think it was a little heavy-handed; the kids can have all the sex they want with each other, perfectly legally, but they take photos and all of a sudden it's criminal?

According to the article, the kids in question were 16 and 17. The FLorida Supreme Court had previously ruled that sex with each other was perfectly legal. By that definition, no, they are not kiddies.

However, the Florida Supreme Court ruled that in the matter of pornographic photos, they are being considered kiddies.

What about the title? I'm asking the question - do people agree with the Florida Supreme Court's definition of child pornography?

It doesn't appear as though FL considers 16 year olds to be "kiddies" as far as haing sex is concerned, that's all. If it were my daughter.. well, different story

I think the laws need to be re-written. If you are within 3 or perhaps 5 years of someones age, consentual sex should not be a crime. And, any adult distributing or receiving and not reporting these pictures should be charged.
I have friends that has sex at VERY early ages, quite a few actually. It is not a crime, just a lack of parental oversight.
The other HUGE factor is the timeline of accepted sexual norms our society. These are the 1st two centuries where we deny that sexuality manifests itself before age 18.

Unbelievable, this came from the majority opinion. The ones that upheld the convictions against those they deemed to young to know what they had done.

The majority also has little idea of how vunerable private email transmissions are. If someone really wanted your mail, they could probably get it. But no one is going to accidently stumble upon these photos.

Shouldn´t be as long as he doesn´t distribute them...

My parents once took a picture of me when i was 2 years old naked in the beach making a sand castle, is that child pornography? (many people have seen them)

Laws need to take into consideration common sense.

If I ever had the chance to have sex when I was 16, you could bet I would have been right on it, regardless what any law enforcement agency says I can or can not do or what anyones opinion was.

That won't ever change and everyone feels the same way at that age. I still do and I'm 24. I'd go back in time and make it happen if I could.

Sex is fun. Everyone agrees.

Personally, if I wanted to take nude pictures of my girlfriend when I was under 18 and look at them later and she had no problem with it, that was my right and my right to privacy to do whatever I wanted. No one has the right to tell me any different. If I they were 12, I might look at it differently. It's not like they gave the pictures to a 30 year old man.
