Terrorists as Pirates

A very interesting article outlining the similarity of terrorsts and pirates, and advocating that the solution is to treat them as such:

This is essentially consistent with what I keep saying all along: suspected terrorists in custody are either combatants subject to the guidelines of the Geneva Convention, or criminal defendants subject to due process of law under the civilian criminal laws of one or more nations, and/or under an international court of justice. There is no "third category", despite the Bush Administration's attempts to fabricate one where one does not exist. Defining terrorists as pirates simply clarifies that they should be treated as criminal defendants.

But, there is. Pirates. That's the whole point of the article. Pirates are people not associated with states who are "enemies of mankind".



No; I'm correct. The article proposes to define terrorism "as an international crime that could be prosecuted before the International Criminal Court". That means terrorists, as pirates (ARRRRB|) would be deemed "criminal defendants."
