Another "zero tolerance" story:

Raleigh Boaze is a Maryland history buff and historical re-enactor who likes to teach school students about what life was like for 18th-century settlers in America. He does so dressed in buckskin breeches, with a Bowie knife and a musket.

But not in Washington County, Maryland, any more. School officials say both the knife and rifle are now prohibited weapons on school property, and that his muzzleloading rifle sends the wrong message to children. "The way kids are today, they could grab one of those and make a weapon of their own," school board president Robert Kline said.

A decision today by a St. Louis judge leaves intact his ruling that has Missouri's concealed gun law on hold at least until the state Supreme Court takes up the matter next month.

Circuit Judge Steven Ohmer rejected claims the concealed carry law violates the state's Hancock Amendment. Opponents of the law claim the law violates the spending-limit amendment because the Legislature failed to appropriate money for its implementation.

Ohmer ruled Nov. 7 the law is unconstitutional but on grounds other than the Hancock Amendment.

The judge also declined to release the $250,000 bond he required the law's opponents to post to make effective his injunction blocking the law's enforcement.

The Missouri Supreme Court is scheduled to hear arguments in the case on Jan. 22.

In his order Nov. 7, Ohmer wrote that "the crux of the case" is the application and meaning the state constitutional provision that says the right to have guns "shall not be questioned; but this shall not justify the wearing of concealed weapons."

The concealed weapons law was adopted Sept. 11 after the Legislature narrowly overrode Gov. Bob Holden's veto. The law allows Missourians age 23 and older who pay $100 and pass background checks and a training course to receive a permit from their county sheriff to carry concealed guns. It also allows anyone age 21 or older to conceal a gun in a vehicle without need of a permit.



I'm still trying to figure out how "shall not justify" is equal to "is hereby prohibited."

And talk about legislating from the bench, he basically said "you brought suit on bogus reasons, but instead of throwing out the case, I'm going to put an injunction in place for my own reasons."

Governor wants rights legislation

COLUMBUS -- Gov. Bob Taft said Wednesday that his aides and staffers from the Ohio House are negotiating in a last-ditch effort to avoid a veto of legislation passed last week that would give law-abiding Ohioans the right to carry concealed handguns.

"I would hope that we could get this resolved as soon as the legislature comes back (in the first week in January)," Taft said in a year-end interview at the governor's residence in suburban Bexley.

The efforts to work out a compromise on concealed-carry have continued despite Taft's threat to veto the bill passed last week, saying it doesn't give the press and public adequate access to personal information about permit holders.

That bill would give journalists -- not the public -- access to concealed-carry records on a name-by-name basis.

Taft said negotiations focus on a proposal agreed to by him and Senate Republicans that would give journalists access to each county's database on permit holders, providing the names and counties of residence.

That falls short of Taft's initial public record demand that called for giving the public access to permit holders' names, counties of residence, and birth dates.

"In the interest of passing a bill, we think if you got names and counties that would be sufficient, just as long as there is full access to the database on the part of reporters," Taft said.

House Republicans declined to go along with this plan last week. But one legislative source close to the negotiations said, "I think there's a likelihood of that (an agreement) happening. . . We're so close we may be able to go."

Dwight Crum, spokesman for House Speaker Larry Householder, R-Glenford, would say only, "We're continuing to work to try and give law-abiding Ohioans the ability to protect themselves and their families."

If the House and Senate both agreed to the new bill, Taft would sign it as well as the one passed last week, with the new bill's provisions being paramount.

In one sign that negotiations are going on, the House, where the bill that passed last week originated, has not sent the legislation to Taft yet. The 10 days the governor has to veto a bill do not start until it arrives on his desk.

If Taft gets only the bill passed last week -- without the new legislation -- he would veto it, said Orest Holubec, Taft's spokesman.

Householder has said he believes he has the votes in the House to override a veto, but Senate President Doug White, R-Manchester, has said he does not.

On the issue of stiffer state laws on gun purchases, Taft said he studied the issue three years ago after a Dayton Daily News series showed Ohio had become a major source of guns used in crimes in other states.

"We already have some state laws that deal with this. You have federal laws. . . What you need is vigorous enforcement," Taft said.

He also said it would be difficult to enact tougher state laws because of the "climate in the state legislature."

The governor recalled that in 2000 he couldn't get enough votes to get legislation he backed requiring the safe storage of guns out of a House committee.
