Interesting. I had no idea that existed. Now, that's just for initial adoption expenses, right? So unless you're adopting a child this year or have carryover from previous years, it won't do that much for you, will it?

I see if you travel to China to adopt a kid, the trip is tax deductible. That's cool. Now, if I could just get a tax credit for my kids' college tuitions. :D

I just went to do my taxes and was told there was a problem with the amount listed as my refund. It was too large. I was then told i had to wait till monday to file so my tax lady could to review the adoption laws. I just received the call saying that the law did change and I get the full remaining credit left. Lets just say it is a large amount..

Adoption Credit for 2010 and 2011
The adoption credit was scheduled to sunset at the end of 2010. However, the massive health care reform legislation extended and revised the adoption tax credit. The health care legislation enhanced the adoption tax credit in three ways. First, it bumped the maximum adoption credit from $12,150 to $13,170. Second, it extended this increased tax credit amount to the year 2011. Third, it made the adoption credit refundable.

No... this isn't entirely true. If you adopt a baby from China, for example, you may spend $40,000 in expenses. To qualify for the credit, you need to document all of your expenses... travel, legal fees, agency fees, food, etc.

If you adopt a child considered 'special needs', meaning an older child (generally older than 5), a child with emotional, behavioral, or physical issues, or a sibling group, you don't need to document any expendatures at all, you just get the full tax credit. For example, our son was a total of about $3000 for legal fees, training, clearances, etc, but I got the full tax credit without having to document anything. That is the policy in order to help increase adoptions from foster care.
