I guessed right on the Ralph being the dealer :) now, the question is - did you guys call the number provided by the "skydiver" or did you call the credit cards issuing bank and verify all the billing and possible alternate shipping address with them ? the CC company does not release that info, but will gladly verify it for the merchant. Furthermore, those cardholders wishing to ship to an address other than the one their bill comes to can nofity their credit card by placing an "alternate ship to" address on file. If you, as a merchant have failed to do any of the above, you did less than due diligence (especially considering the order has to have been $a few grand). None of this however makes the gear any less "yours" or any more "Erics".... The above was meant to be more of a helpful suggestion than a stab at ya'lls.
  3. Your post insinuates that the dealer is NOT part of the skydiving community. Which is quite the opposite, as the said dealer has been around longer than Eric. Neither are valid points however, as being part of skydiving community has no legal standing in the matter of good to which the title is being challenged.
  4. I am a bit taken back by responses such as yours. We were not given enough facts to make a fair judgement. If the dealer in fact was taken advantage of, than it's just as reasonable of them to ask for the gear back, as it is of the person who paid $4100 for the said gear to be seeking legal advice and trying to not get screwed in the transaction. What I mean is that this internet tar-n-feathering is no good for the seller OR the buyer. If most people on this site were dealers, the equivalent ruckus should cause a few to yell "I want ot know who this Eric person is so I never have to sell to him again and deal with his BS". Like many others, I personally think this is just a bad situation for both parties. I cannot fault the dealer or the buyer. but my money is on CallRalph being the dealer :)

  6. very simply put - unless you have a JD and know the interstate commerce laws as well as the laws of the involved states and the UCC, you have no business advising Eric of proper course of action. you advise him based on your personal convictions, and that's useless to someone who doesn't want to loose $4100 (minus container)
  7. A Stiletto is _not_ an intermediate canopy. It's the most sensitive to toggle input out of all the PD canopies ever made. Subsequent PD designs were been detuned because John LeBlanc (he's been designing canopies at PD for 25 years) observed experienced jumpers having problems keeping the canopy level while landing Stilettos. Failing to have good body position and deal with openings will also lead to cutaways on a Stiletto. I feel that Vengeance is an even more sensitive. But that's just me...
  8. If you can afford all new gear, and the learning curve/frustration of packing a new canopy, and the 170 is a safe choice for you - you will be very happy. That is, until the first few times you PLF and get your new shiny rig all dirtied up :) My only suggestions is lots and lots of Scotchguard for complete happiness :)

  10. it doesn't matter who Eric is, or how he got the gear. If it has been reported stolen (which it has) - he can be the nicest guy ever, but he is still in possession of stolen property. At least that's how I understand it. The person who he bought it from, even if paid for in in good faith, never had the title to the gear as the original owner (gear shop) has never passed it on due to it being a fraudulent sale. Of course a legal professional should be the only person whose advice should be listened to.
  11. this situation stinks as at the very least it is causing a lot of headaches. I do know that as a vendor, taking credit cards comes with certain responsibility - such as it being the VENDORS risk when the product is shipped anywhere but the billing address. I would love to know what the attorney(s) say. And yeah, I would be happy to pitch a little in to cover the costs. And personally, I do not think of the OP as a thief - he is just a victim of very unfortunate events. The only thief is the person who deliberately used a stolen CC to purchase the goods.
  12. yes I have verified people experience. Calling the DZO is a good start. Otherwise there always seems to be someone at their DZ who I know :) No reason to sell people things that they are likely to hurt themselves with. And as far as I know nobody thought bad of me for refusing to sell to under qualified buyers. just my 2c

  16. I had 81 skydives. But that was before the BMI program was started, wingsuits were pretty new. Personally, to think about it now, it was a waste of a jumpticket - I was not aware enough in the sky, so I just spent 60sec diving straight down. The second jump went a little better, as I had a 70sec flight and had no clue where I opened and nearly landed in the powerlines. So do what you want, but be ready to pay the price. In other words I don't recommend it based on personal experience. But of course, everybody nowdays has 100 jumps but "my instructors told me I fly/fall/land like someone with over 500".

  18. It's a good idea to check line continuity before starting to pack, many have jumped step through when they were not careful. Also a good idea to untwist your brake lines each jumping day. Or every jump if you are not too lazy/busy.

Granted, I don't have some un-Godly high # and whatever color star behind my name, but all the feedback I do have s positive. type in ralffers in the ebay search box and you'll find my profile. 29 feedbacks in 3 years, with 1 transaction in the last 6 months. looks like in the last 15 days you sold a $120 item, and also listed two $150 items. Personally I think eBay is so tired of scams, and of people being gullible and not seeing the obvious signs and subsequently getting fucked, that they have their fraud detection tools tuned way too high (sensitive). What your account has is a classic "irregular pattern" and they just want to verify that your acct was not taken over by a good old Nigerian. Bullshit ? Well, sure, unless you are the person who just sent $1000 to a fake seller and are now able to recover the funds... Seriously though, I think they now wound it way too tight for normal persons liking.

  22. oopsie. looks like a new and "improved" rule. ya know, this is definitely news to me. Looks like the rule is applies to newer/lower feedback/less active account. As much as I have defended paypal in the past, this move seems asinine, as it will loose them a lot of business due to the fact that all of us want to get OUR money ASAP. their previous systems told you to NOT ship the item until the buyers authenticity has been verified. I am sorry dude, seems like they got you by short and curlies.

  24. If they believe the funds were sent to you from a hijacked account, they will investigate and let you know. They are usually very quick to send you an email and advice not to send the item. In fact if that's the case they are not holding YOUR money, but the buyers. Think - if you were taking credit cards with your own terminal, and ran a charge for a stolen credit card, it would be 30 days or more when you will receive a notice of charge dispute BY MAIL and you will be SOL. With paypal they actually monitor and their advanced warning systems work well. Can you post the email they sent you (obviously without the private info). I am guessing it was something like "NOTICE OF PAYMENT REVIEW: DO NOT SHIP." Those usually clear in less than 24 hrs if the buyer is legit. Good luck
