MakeItHappen 15 #26 January 29, 2009 QuoteI would have sent you a PM as a response to yours, but you do not acccept PMs. weird... thank you for sending me the documents. Can you send me anything else you have ? just a disclaimer : I am not an attorney, just someone who likes to argue. I also have met all the defendants (though it has been a number of years, and prior to the incident) I'll send you a couple of other things. Here's the 'argument' you should consider. Most DZs think that their waiver will get them out of a lawsuit, post haste. Waivers do not prevent a lawsuit from being filed, but it supposedly should get them out of it quickly. If Aerohio is really out of business, then the waiver meant to get them dismissed from a case did not happen. In addition, other entities (the AC owner, the pilot, the mfg and USPA) were named as defendants and are not able to get that dismissed by the court (supposedly this should have happened if the waiver did what most people think it should do). That tells me that the waiver is not as good as some might think. These waivers are apparently very dependent upon state laws, so a generic one-size-fits-all may not be the answer. If the interpretation of what a wavier is supposed to do for a business, does not really do that, then there is a problem. What can we do about it? Have you considered changing you screen name to LikesToArgue? ;) .. Make It Happen Parachute History DiveMaker
likestojump 3 #27 January 29, 2009 I don't think we are really arguing here - just trying to discuss the situation. The bottom line is that you cannot waiver negligence, no matter how many pieces of paper were signed, and how many videos were shot.
scroadload 1 #28 January 30, 2009 Waivers may make it difficult for the person signing the waiver to sue however a third party is not bound by it, hence many DZ's and others now require video of that person, in there own voice, instructing others, family, assigns, personal representatives, heirs etc. not to file suit.D-2626, SCR1999, SCS641, NSCR2350, GW6909 Blue Skies!!!!!!
