dayle 0 #29 July 15, 2003 I think you should blur everything else so it is in no way identifiable, except for the important part!! THE BOOBIES!!! LOL Make sure you blur the tandemaster out also. Hopefully you also have a sky shot so the ground isn't an identifiable area. Basically if you make the shot so average in eveyway that it could be anyone.....you should have no problem in a court of law, should it come to that. lawrocket 3 #30 July 15, 2003 Actually, a very real danger has become apparent to me in thinking of this. There are comments about the tandem master covering the breasts. This could be misconstrued on video and turn into allegations of sexual assault against the tandem master. Sure it isn't true, but the joking suggestion that the TM was doing more than covering them has already been made by more than one poster. Posting a video like this might be adding adding coals to the fire, and could have serious adverse consequences beyond a copyright lawsuit. VanillaSkyGirl 6 #33 July 15, 2003 As a woman, I'd have to say there is NO WAY that this tandem student could not have realized that she was going to lose her small top or flash the camera. NO WAY!!! Even if a woman is quite firm (thanking my genes), having larger breasts makes it difficult to walk around braless as nipples would show and breasts would jiggle. It is something that women wear for attention as it is NOT comfortable. Breasts are heavy, and they sneak out of bikinis (Read my "Last Friday night" post in Talkback), small tops, etc. This girl may have become embarrassed afterwards at how silly she looked, but she knew exactly what she was doing. She was definitely trying to look sexy. Any woman wearing no bra or a belly/halter shirt knows that she will get attention from men. For God's sake, we women get attention even if we are wearing a loose sack. I'd have to say that I doubt that she did not think about the consequences that her clothing could have. By the way, I have never done a tandem, but aren't these people supposed to wear a jumpsuit? She knew that you were filming her, and she chose to wear that top with no bra on purpose. She knew what she was doing. It makes me sad that women have to resort to geting implants or pulling stunts like this for attention. Maybe that is why I love jumping. I look disgusting when I jump with messy hair and a sweaty face, but I feel beautiful. I feel like I am a star because I am doing something so special. I was wondering if this tandem student was going to go through the AFF progression? I hope that she does, so that she can find her inner beauty. I have been making my living taking (or a good portion of it) taking pictures for 10 years. I have been everything from a stringer for local daily rags to a staffer on two top-25 US-circ magazines. You are pretty much correct about the "work for hire" copyright assignment. But (big but) the photographer must sign a "work for hire" contract. Simple employment is not that. Hiring someone to video or photograph something for you does not give you the copyright. "Work for Hire" contracts exist for this specific reason. As the author of the work, he owns the copyright until he signs that away. Further, if the person in the video has signed a model release, he may use that video or images from that video in any way he so desires, provided the proper wording of the release. If he chooses not to post it, I commend him on his ethics. Plus, if the TM didn't say anything about it, she probably thought she'd be fine. Now personally, I am large-breasted and I wouldn't go anywhere without a bra on, and I agree that it's uncomfortable or even painful! But, different strokes for different folks I guess. Wearing a small top with a bra might be confortable (not to mention cooler in the heat) to some. And one other thing, most people consider their jumpsuits quite the fashion statement, and will pay extra to have it look the way they want. We all try to look a certain way - even when grubby. Then it's up to them. I've had a few tops come loose on my students over the years, most take it in stride. Everytime it happened, I always thank hem after the jump, least I can do! Not everyone is prepared or rational about the consequences of jumping out of a plane. Also, I wrongly assumed that going braless is not comfortable for all women larger than a "B" cup. About jumpsuits...I again assumed that all tandem students wear them because in the DZs that I have visited so far (Perris, Elsinore, Air Adventure West, Taft, San Diego), the tandem students wore jumpsuits. Yes, this has been in 100+ weather. I do have respect for people doing topless, naked, bikini or lingerie jumps. My personal belief is that there's nothing wrong with nudity if you want to be free.
