Longmont City Council will take up skydiving noise

Recommended Posts

There is a community growing right next to Skydive Perris, one of the skydiver that I knew was just looking for a house, being a skydiver he asks the realtor about the airport being next door, and the realtor tells him, "it is a small parachuting club that operates every once a while"

He told her to fuck off after hearing that lie.

:D:D:D

Awesome!

******I always wanted to jump a 727, just saying.

I don't think we can land one at Vance Brand. Runway's not long enough.

An extension of the runway will be considered, but length is only one aspect of the runway that relates to or controls the type of aircraft that can utilize the airport. In addition to length, the weight bearing capacity of the runway is also a limiting factor. The current runway is weight-limited to typical corporate jet aircraft weighing up to 30,000 lbs with single landing gear, or not more than 60,000 lbs with tandem landing gear. If an extension of the runway is constructed, the weight limits of the existing concrete runway will still control the size of the aircraft that could use the runway. There are not currently any plans to increase the structural weight capacity of the runway. Quite simply, the airport was not designed or built to accommodate larger aircraft. Also, the layout of the existing airport property, the spacing of taxiways and the proximity of the hangers to the runway limit operations at the Airport.

Tim Barth,
Longmont Vance Brand Airport Manager

Yeah yeah, you know who says "It's not the length of the runway, it's how you use it"? Someone with a short runway!
I'm trying to teach myself how to set things on fire with my mind. Hey... is it hot in here?

This thread just hit 1000 replies.

Because you see,,,,, ,,,, it's not anyones' call, except the principals actively involved with the skydiving center, who RIGHT NOW, need a chance to Exhale,, then take a deep breath, Grin B| , and then decide for themselves..... what to do and what Not to do...

Not for forum posters to "declare a boogie " or opt for this airplane or that airplane,,, despite the temptation to do so.....
Hopefully, locals will support the dz , as in the past, visitors will patronize the place without overwhelming it.... and skydiving WILL continue at whatever pace, the DZO decides. :)I personally witnessed The demo team , this past Dec. as they performed a flawless skydive into the Broncos -Bills Game on a clear and sunny bright Sunday afternoon, revving up, ALL who were in attendance. !!! They rocked it....... ( as in,,, The Rockies ) !!!!

If we have a boogie here we'd probably burn through our 50,000 skydives for the year in the month the boogie occurs. Not that I think Mile Hi would mind THAT too much.

The weather's been shit for the last, though. It's raining today. I want to at least go do a hop and pop, but it's just not going to happen. Pretty crazy, for Colorado. If I wanted to live somewhere it rained all the time, I'd have moved to Seattle. I'm kind of bent out of shape Seattle decided to move (its weather) here :S

It has been nice here... a bit overcast today... but it was very sunny all week... too hot even.. I am so not ready for 78 degree weather and sunny yet;)

I would suggest that our industry owes a great deal of "thanks" to CQS; they've now generated a recent precedent that is well-defended, offers up solid language and foundation for any future attorney seeking a similar lawsuit elsewhere in the country.
It's unfortunate Mile-Hi has had to bear the weight of the cost. Supporting the DZ is the best thing for any of us to do, as their defense will stand for every other DZ in the USA for many years to come.
Well done Frank and team!

If they don't appeal, these crazies will likely file another lawsuit one after the other until they run out of cash or die. Their only motivation will be to bankrupt the operation if it does not stop. The solution? We should all jump there ;)

Sad to say but this could just be the beginning. There is no telling what this woman can dream up to keep her cause going. And there's no shortage of attorneys who will take her money, or donors' money while stringing her along on a bogus fight.

Her words:

Regardless, Gibbs said she and her supporters would not give up and in addition to considering filing an appeal, they also want the Longmont City Council to pass an ordinance restricting noise from Mile-Hi, despite the judge's ruling suggesting the city did not have that power.

"It's an extreme disappointment but we've known from the very beginning that this was going to be a very difficult case ... but still to come face to face with an outright loss is hard," Gibbs said. "We're not done. We're not going to give up, we're never going to give up and we are simply on the leading edge of fighting this good fight over noise pollution. It's going to take some time but I'm confident that we will prevail and in fact, we are not stopping until we do."

Time will tell if the reality of spending another $100k on legal fees will temper her enthusiasm.

She probably didn't spend much of her own money, she did a bunch of pandering for legal fee cash.

Those comments make me question whether she is fully in touch with reality at this point.

The judge said flat out that this is not "nuisance noise", it's "annoyance noise." For example, the most annoying sound to me is that of a mosquito buzzing when I'm trying to sleep. It certainly isn't loud, but I'm not going to be able to sleep while I can hear it.

The fact that the site visit by the court and Kim's own video show that the noise isn't loud demonstrate that pretty clearly. I still love how she has to whisper to keep from drowning out the sound of the plane.

Her intentions to "keep up the good fight" are a little disturbing. Her apparent intentions to try to get a local law passed are more so. The court clearly acknowledged that it doesn't have jurisdiction over the matter. Nor does the local government.
Yet she ignores this.

She seems to want to appeal, yet I doubt she has any valid grounds. "I don't like the verdict" doesn't count. Skimming the notes (Thanks a lot for those, Ryoder) and the verdict, I can't see any significant errors that would justify an appeal. (not a lawyer, but an 'interested amateur')

While I'm a big advocate that Mile High should "take the high road" in this, I wonder if they have a valid harassment complaint. If Kim and the CQS bunch continue with their complaints and efforts at getting unenforceable laws put in place and pointless lawsuits, when does that legally become "harassment"?

The denial of every claim in the suit is a pretty clear message that the claims by CQS are frivolous.

A solid finding of harassment against the CQS crowd would open them up to a whole host of sanctions. Including compensation for Mile High's costs in fighting them.

As I noted in a now deleted post in the other thread, I've been through this sort of situation before (not skydiving related). Repeated complaints to the cops (to the point that the cops said to the complainer "stop or face sanctions"), attempts to shut us down via ordinances, that sort of thing. Our lawyer said we probably had a valid harassment complaint, but the potential negative consequences of pursuing it were more than we were willing to risk. But the potential upside was pretty appealing. Restraining orders, potential punishment if the complaints continued, compensation for costs incurred. Basically a "cut it out and leave us alone or else."

If anyone wants to join the squabble, over at the Times-Call there is a debate going on in the comments section below this article: http://www.timescall.com/news/ci_28178689/longmont-airplane-noise-lawsuit-over-but-questions-remain

"Nature_Girl" is Gibbs mommy, (who lives in FL), and at the moment the debate is pretty much her versus everyone else.:D

I would just strongly urge everyone to keep it civil. Please. Let's keep our eye on the big picture.

***Debating in the comments section of a newspaper solved everything...never.

Nope, but it is seriously entertaining! You can see where the daughters genes came from. :S

Entertainment? that is one of three purposes of the internet. The other two are google maps and porn.

Pretty telling, how all the Mile High supporting comments have a lot of "Likes", and all of the CQS supporting comments have a lot of "Dislikes".

Ms. Gibbs' silliness on Twitter is almost comical.
In a mad hatter way.

Yeah. It's quite clear that despite the clear truth that the judge saw, Kim is going to believe what SHE wants to believe, and nothing is going to change that.

Having a few cronies do the majority of noise complaints, including one with an automated system, did NOTHING to help her case, in fact, it actually hurt it. IMO.

There really is no winning with these people. The best you can do is just leave them be to tilt at their windmills.

Ever since I saw the video she posted on Youtube of herself filming a cargo flight at 2am I knew she wasn't fully in touch with reality.

Made for a funny video. Shame she took it down.
