Indeed there is. The first can at least arguably be justified under military combat rules of engagement. The second is either a violation of American law and Constitutional principles, or a violation of the Geneva Convention. And no, no matter how hard the Bush and Obama administrations have argued, there is no legitimate third category that gives Americans a pass to do that, or even to facilitate it being done by proxies.
