If we did know, there would be know need for torture, which, ironically, is also why torture is ineffective. Don't you mean:

There is a world of difference between blowing up people who happen to be in an area who might not know anything and the targeted torturing of somebody who admits they are a terrorist.

Indeed there is. The first can at least arguably be justified under military combat rules of engagement. The second is either a violation of American law and Constitutional principles, or a violation of the Geneva Convention.

And no, no matter how hard the Bush and Obama administrations have argued, there is no legitimate third category that gives Americans a pass to do that, or even to facilitate it being done by proxies.

I'm pretty sure he was speaking generally & academically, not re: a specific occuurence. So in that regard, it always matters. We must have these discussions and debates to contribute to the forming of policy as citizens in participatory democracy.
