Andy9o8 2 #1 January 8, 2009 QuoteHusband demands money for kidney http://abclocal.go.com/wabc/story?section=news/local&id=6591415 GARDEN CITY, N.Y. (WABC) -- A Long Island surgeon embroiled in a nearly four-year divorce proceeding wants his estranged wife to return the kidney he donated to her, although he says he'll settle for $1.5 million in compensation. Dr. Richard Batista, a surgeon at Nassau University Medical Center, told reporters at his lawyer's Long Island office Wednesday that he decided to go public with his demand for kidney compensation because he has grown frustrated with the negotiations with his estranged wife. Dr. Batista fought back tears after talking about a bitter divorce battle he's embroiled in with his wife of 15 years. "There's no deeper pain or betrayal from somebody you loved and devoted your whole life to," he said. Batista's a full-time surgeon, who married Dawnell in 1990. They would later have three children and eventually he saved her life by donating his kidney to her in 2001. She filed for divorce in July 2005, although he claims she began having an extramarital affair 18 months to two years after receiving the kidney transplant, his attorney, Dominick Barbara said. Batista says she had an affair.

jtnesbitt 0 #3 January 8, 2009 I would be curious to see the legal loophole his council is using. There is no way they can really expect compensation for the kidney, thats totally illegal. Maybe by going public they hope they get a quick divorce settlement and other compensation?"If this post needs to be moderated I would prefer it to be completly removed and not edited and butchered into a disney movie" - DorkZone Hero
Andy9o8 2 #4 January 8, 2009 Well, obviously my motivation for the OP is tongue in cheek, and a poke at push-polls. But I gotta tell you: in many legal disputes I've seen involving very hard feelings (and domestic cases and business-partner breakups are the prime examples), each party's main motivation is frequently less about getting something for themselves, and more about preventing the other person from having or keeping it. Still, though, consider: suppose you donated a kidney to your spouse only to have your spouse reward you by cheating on you shortly thereafter? I'll bet not many people other than Jesus Christ Himself would be ready to turn the other cheek on that one.

Given the way she betrayed him, I don't fault him for making her betrayal very public, and any humiliation she feels was brought on by her own actions. I can also see where it could be reasonable to consider the kidney when determining a fair division of assets, but I have absolutely no idea how one would assess a fair value for it. Edit to add: It appears the best thing this guy could have done would have been to let her die. He'd still have two kidneys and all his stuff, and as a bonus, he'd have avoided the emotional trauma of being betrayed by someone he loved. Blues, Dave"I AM A PROFESSIONAL EXTREME ATHLETE!" When I heard the story, I wondered if there was any venue (state law, or eccentric judge) that might consider the kidney as part of community property and factor it into the division of assets. Likely not 1.5M worth, but 250k? Certainly he paid a price in lower overall health and not having the redundant organ anymore. rehmwa 2 #17 January 8, 2009 I don't think he wants the kidney, just the publicity that: his ex is a cheating straw haired pig-whore I mean, if he told that to the press, I doubt it would get much air time at all. Of course, she'll counter sue for the bad press. pig whore edit: Seriously - I can see a good argument that the value of his shortened life span and her life being factored into the settlement. peregrinerose 0 #22 January 8, 2009 I think whether or not she cheated is completely irrelevant to his reaction regarding the kidney. The marriage is over, divorce as amiably as possible and move on. Rewarding her pettiness with childishness of his own doesn't solve anything. It's a battle just not worth fighting, there's nothing to gain. I liked his plane crash stories and had a laugh about the tree landing I saw, but didn't particularly care for the wall strike he had after neglecting to track on our two-way from a 2700' cliff. Really ruined the vibe.
happythoughts 0 #24 January 8, 2009 The kidney was a gift. Just like jewelry, you aren't going to get it back. He isn't asking for the house. I guarantee that she will. She is going to get the house until the kids are 18, plus mega-child support. (Just the person of character that you want raising your kids.) I seriously doubt that she cares if people find out about the affair. The other party has probably moved in already. I'd consult with the b/f about an alternative source for acquiring a kidney.
