Misdemeanor speeding in CA

Recommended Posts

Anyone know a good traffic lawyer around Laguna Niguel.

I was clocked doing 100 on the FWY out here. Can't really afford for a misdemeanor to be on the record while trying to get a TS clearence. I have nothing else on the record.

Any free legal advice would be appreciated as well.

Rich- find Stan Smith he is in Niguel off of Moltin and El Toro. He is a good guy. You should have told the CIP that you were late for your ship to Iraq.:P

I live in SoCal...what road were you on and what kind of cop busted you (CHP, Sheriff, Local)?
So I try and I scream and I beg and I sigh

Damn Cap'n!

Slow down a bit! 100mph?
Well, i guess in the scheme of things it isn't all that fast.

HWY 5 south about 2 miles prior to PICO. CHP pulled me over. 100 mph. Cop was actually a nice guy. Funny part was that I could have gotten a ticket for not having proof of insurance in the car (I am insured just didn't have it with me). He wrote down the insurance company name, but never asked for the proof or the number.:o

Any help appreciated.

Kyle dude!

Got your message. What dates are you in town again? We will definetly make the tunnel. If you are going to be in town on a Monday we need to go to Meeker Monday. Christy organizes it. GREAT deal. You pay 117 and you are guaranteed 10 min. Best part is though that you are grouped up with others for 2 and 3 ways. If they are in there during your time you are in there during their time. I got almost 20 min for my 117 last Monday. I also know a few GREAT coaches out here that would coach very inexpensively.

Now back to my search for an attorney and not getting screwed on this ticket.

Rich

Um, I hate to say it but 100mph is pretty common on the freeways in So Cal, maybe more like 90 but no one looks twice at someone driving that fast around here...except for the cops :D

Even then, they'll notice the mega-lane-changes to draw their attention. Overall you're right, 100MPH isn't all that in SoCal... B|

Sorry to be off-topic, again, but Meeker Monday was awesome. YAY! (Christy was great coach.) She said that now that she has seen how I fly in there, she will try to match me up with more people next time that I want to fly. :))

Anyhoo, that's too bad about your misdemeanor, Rich. :( Good luck in dealing with it.

Yes, but as fast as I as going this isn't a speeding ticket, it's a misdemeanor traffic violation that will probably go down as "reckless driving"

Thats still a violation of the vehicle code, read infraction, not the penal code. You can loose you lic. and pay a big fine but they don't throw you in jail. A misdemeanor is a crime punishable buy up to one year in jail. (I think)

I was busted south of Ventura on the 101 a few months ago. It was an unmarked white CHP (no star on the side or anything) but the thing that surprised me was that he had rear-facing radar. He was sitting by the side of the road and had me made long before I even got to where he was.

Bummer. [:/]

Tried to PM Kallend being that he is Mr Physics, but he isn't accepting.

Here is what I'm attempting to prove. My car's ECU reads MPH based on a standard wheel diameter of 15". If I have a 17" wheel diameter how fast will my car be going if the speedo is reading 90?

Something along the lines of 1 mile / circumfrence = Revolutions per mile

revolutions per mile / miles per hour = revolutions per hour/ 60 = revs per min

So if the circumfrence is changed it should mean that my speedo reads slower than I am actually going yes?

So question 1: Is my formula correct?
If yes... GREAT!
if no.... What do I need to correct?

You'll get another ticket if you bring that up. By law you're supposed to change that if you change your wheels.

I know that my speedometer is almost exactly 2miles low with the 33" tires on my truck.B|

hmmm.... I would think that the only way you MIGHT get away with that is if you pleaded ingorance about the tires being bigger. Good luck... how fast was the other traffic?

I can't remember where I found it, but there's an online tire calculator that will tell you how far of your speedometer is based on new tires. I ll look around to see if I could find it

found it lummy. Thanks.

Don't think I'll go with this defense.

When I go in on Monday to request a court date I'm going to see if they'll let me plea bargain to keep it out of the court and not clog up the system any more than it already is. I'm a safe enough driver that one ticket isn't going to hurt me in the long run.

If it turns out like it did when I got a ticket for 100 mph on the freeway in california. You will get a notice in the mail to pay a fine. As long as all the patrolman put on the ticket is speeding they will not try to get you with reckless driving. So it should just be a simple fine.

Fight the ticket using "Trial by written Declaration" it's printed on the back of every ticket.

Go to this web site www.ticketassassin.com
Read more about it for yourself.
Follow the instructions. Even e-mail the lawyer who owns the site for advice.

The really cool thing is, you never have to step foot in court if it all works in your favor.

Yes it works, I ride sport bikes with a rather large club (80 plus members) so far the results have been very good for many members including myself.

I gave this info to Eli from the Flyboys and he has fought and won several tickets.

Good Luck,

Nick
